Binay’s suspension held after TRO issued by Court of Appeals
Through Associate Justice Jose Reyes Jr., a 60-day temporary restraining order (TRO)was issued blocking the 6-month suspension order of the Office of the Ombudsman due to anti-graft body’s preliminary investigation into administrative charges against the younger Binay and several others for the supposed overpriced P2.2 billion Makati City Hall Building 2.
Apart from quoting the Rules of Court and Supreme Court (SC) jurisprudence on restraining and injunctive pleas, the appellate court said that Binay’s suspension had to be stopped for its "possible outcome on the electorate" of Makati City.
The court added that it will schedule a hearing on March 30 and 31 on Binay’s plea for a writ of preliminary injunction.
A writ of preliminary injunction will prolong the TRO indefinitely, and will only stop its effect when lifted by the CA.
